Terms of Use

IMPORTANT – READ CAREFULLY: This BobCAD-CAM Terms of Use (this “Agreement”) is a legal agreement between you (either an individual or a single entity) (“Subscriber” or “you”) and BobCAD-CAM, Inc. (“BobCAD,” “we,” “us,” or “our”) for the software, services, and materials that accompany this Agreement, including associated media, License Activation Codes, documentation, and access to BobCAD’s services (collectively, the “Licensed Software” or “Services”).
BY CONTINUING TO USE BOBCAD, BY INSTALLING, COPYING, OR USING THE LICENSED SOFTWARE, OR BY MAKING PAYMENT FOR THE SERVICES, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO EACH AND EVERY TERM, DO NOT INSTALL OR USE THE LICENSED SOFTWARE; YOU MAY RETURN IT TO YOUR PLACE OF PURCHASE FOR A FULL REFUND, IF APPLICABLE, SUBJECT TO THE REFUND POLICY SET FORTH IN SECTION XVII BELOW.
By continuing to use BobCAD, it is agreed that this Agreement governs the terms of your license to use BobCAD-CAM software. Where your purchase was processed by Cleverbridge as Merchant of Record, the Cleverbridge Customer General Terms shall apply to the purchase transaction. In the event of a conflict between this Agreement and the Cleverbridge Customer General Terms, this Agreement shall control solely with respect to the license rights and obligations for the Software. This Agreement becomes effective when accepted by Subscriber and approved by BobCAD.
I. Capacity to Contract and Consideration
For purposes of this Agreement, “Merchant of Record” refers to the authorized reseller, currently Cleverbridge, that handles anything transactional and order-related under separate General Terms and Conditions provided to Subscriber at the time of purchase. Contingent upon Subscriber’s compliance with the terms of this Agreement, BobCAD grants Subscriber access to and use of BobCAD’s products and services. Payment for the Services is processed by BobCAD-CAM’s authorized Merchant of Record at the time of purchase. Nonpayment will be considered a material breach of this Agreement and Subscriber’s access to the Services will be suspended. BobCAD reserves the right to terminate Subscriber’s account for nonpayment more than sixty (60) days past due.
II. Access and Limited License
A. Access to Services
Access to our services through Subscriber’s account is limited to Subscriber only as a single user unless Subscriber is a corporation or entity. For each Subscriber that is a corporation or entity, only authorized users with a valid license key may access our service. The number of users is limited by the number and type of subscriptions or licenses purchased.
B. Proprietary Information
The BobCAD application and much of the information made available through this service is proprietary information. Proprietary information includes, but is not limited to: articles and other data accessible through the service, the computer software (and source code) used by our system, documentation, the end user interface, the name of our system, and the “look and feel” of our system.
C. Grant of License
Subject to the terms and limitations of this Agreement, BobCAD grants Subscriber a limited, non-exclusive, non-assignable and non-transferable license during the Term to allow Users to access and use BobCAD and the information contained within it. You may not permanently store or redistribute any information accessed through our system. No copying, reproduction, sale, download, transmission, transfer, publication, storage, printing, redistribution, or other use beyond the temporary limited rights specified herein is permitted.
D. Installation and Use Rights
You may: (a) install and use a copy of the Licensed Software on a single personal computer (“PC”) as a single user for your own internal business purposes; and (b) create a backup or archive copy so long as it includes the BobCAD copyright notice. You may not concurrently use a single license: (a) on two or more PCs; (b) on two or more virtual PCs; (c) by two or more users; or (d) by multiple instances of the same user.
E. License Grant for Remote Desktop
You may use remote access technologies to access your licensed copy of the Licensed Software, provided that only the primary user of the PC hosting the remote desktop session accesses and uses the Licensed Software with a remote access device. These rights do not permit simultaneous use on both the host PC and the access device.
F. License Grant for Internal Training or Documentation
Screen captures, videos, websites, and other training or documentation materials (“Multi-Media”) may be created while using the Licensed Software for internal, non-commercial reference purposes only. You may not sell, license, or distribute copies of the Multi-Media, grant customers rights to distribute the Multi-Media, or create obscene or scandalous works using the Multi-Media. You must indemnify BobCAD against any claims arising from your use or distribution of Multi-Media.
G. License Grant for Documentation
Documentation accompanying the Licensed Software is licensed for internal, non-commercial reference purposes only. You may not sell, resell, license, rent, lease, lend, or otherwise transfer the Documentation for value, or distribute the Documentation through Internet-based services.
H. License Activation Codes and Technological Measures
THERE ARE TECHNOLOGICAL MEASURES IN THIS SOFTWARE DESIGNED TO PREVENT UNLICENSED USE. You may not be able to exercise your rights under this Agreement until your subscription account is authenticated and activated. Authentication may be required periodically to verify active subscription status. BobCAD will use appropriate security mechanisms to confirm you have an active, legally licensed subscription. If you do not have an active subscription, you are not allowed to install or use the Licensed Software or access updates.
I. No Illegal Use
BobCAD and the information contained within it may not be used in a manner contrary to, or in violation of, any applicable Federal, state, or local law, rule, regulation, or ordinance.
J. No Rental/Commercial Hosting
You may not rent, lease, lend, or provide commercial hosting services with the Licensed Software.
K. Not For Resale Software
Licensed Software identified as “Not for Resale” or “NFR” may not be sold for value, transferred, or distributed in any manner to a third party. NFR licenses can only be used for demonstration, training, test, or evaluation by BobCAD or an authorized BobCAD VAR (Value-Added Reseller).
L. Educational Edition Software
To use Licensed Software identified as “Educational Edition” or “EE,” you must be a “Qualified Educational User.” For qualification-related questions, please contact BobCAD or a local BobCAD VAR.
III. Security
You are responsible for maintaining the confidentiality of passwords, user names, and account information provided in connection with this service. If you allow someone else access to your account, your account may be terminated and we will have the right to hold you liable for all unauthorized use. You agree to immediately notify BobCAD at support@bobcad.com of any unauthorized use of passwords, user names, or accounts.
BobCAD will maintain commercially reasonable administrative, physical, and technical safeguards designed to protect Customer Data from unauthorized access, disclosure, alteration, or destruction.
In the event of a confirmed security incident affecting Customer Data maintained by BobCAD, BobCAD will provide notice as required by applicable law.
IV. Privacy
This service is subject to the privacy statement posted at https://bobcad.com/privacy.
A. Consent to Use of Technical Data
You agree that BobCAD and its affiliates may collect and use technical information gathered as part of the product support services provided to you, related to the Licensed Software. BobCAD may use this information solely to improve our products or to provide customized services or technologies to you. BobCAD will not disclose this information in a form that personally identifies you.
B. Customer Data Ownership
Subscriber retains all right, title, and interest in any Customer Data uploaded to, generated by, or stored within the Licensed Software. BobCAD retains all right, title, and interest in the Licensed Software, Services, documentation, and all related intellectual property rights.
V. Disclaimers of Warranties and Liability
A. Changes to Services
The data, information, services, and functions provided by BobCAD may change at any time as such data, information, services, and functions are updated, modified, or otherwise altered by third parties providing information to BobCAD.
B. Limitations on BobCAD’s Responsibility
BobCAD is not responsible for: the content, quality, integrity, or performance of the information provided or transmitted by this service; errors or problems related to transmission of data; or any direct, indirect, special, exemplary, punitive, consequential, incidental, or other damages arising out of this Agreement or Subscriber’s use of this service.
C. “AS IS” Disclaimer
BOBCAD AND ITS SUPPLIERS MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, IN CONNECTION WITH THIS AGREEMENT. THE SERVICES, THE SOFTWARE, AND ANY OTHER PRODUCTS OR SERVICES PROVIDED UNDER THIS AGREEMENT ARE PROVIDED “AS IS” AND WITH ALL FAULTS AND THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH SUBSCRIBER.
D. Disclaimer of Implied Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOBCAD DISCLAIMS ANY IMPLIED OR EXPRESS WARRANTIES, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
E. No Liability for Unavailability
BOBCAD SHALL NOT BE LIABLE FOR DAMAGES CAUSED BY THE UNAVAILABILITY OF THE BOBCAD APPLICATION. BOBCAD DOES NOT REPRESENT OR WARRANT THAT THE SERVICES OR THE SOFTWARE SHALL OPERATE ERROR FREE OR UNINTERRUPTED, SHALL MEET ANY OR ALL OF SUBSCRIBER’S PARTICULAR REQUIREMENTS, OR THAT ALL ERRORS OR DEFECTS CAN BE FOUND OR CORRECTED.
F. Third Party Products and Services
BOBCAD DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES WHATSOEVER WITH REGARD TO PRODUCTS OR SERVICES FROM THIRD PARTIES AND ASSUMES NO RESPONSIBILITY OR LIABILITY WITH RESPECT THERETO.
BobCAD is not responsible for the contents of any third-party sites or services, any links contained in third-party sites or services, or any changes or updates to third-party sites or services. Inclusion of any link or access does not imply an endorsement by BobCAD.
G. No Warranty of Timely or Accurate Services
BOBCAD MAKES NO WARRANTY OF ANY ABILITY TO DELIVER TIMELY OR ACCURATE SERVICES.
H. Human and Machine Errors
The use of BobCAD involves the likelihood of some human and/or machine errors, delays, interruptions, and losses, including inadvertent loss of data or damage to software, hardware, and media. In no event shall BobCAD be liable for any such errors, delays, interruptions, or losses.
I. Force Majeure
Performance of this Agreement by BobCAD is subject to interruption and delay due to causes beyond its reasonable control, such as acts of God, acts of government, war, hostility, terrorism, civil disorder, the elements, power failure, equipment failure, industrial or labor dispute, or inability to obtain necessary supplies. BobCAD shall not be liable for interruptions or delays from these causes.
J. Limitation of Liability
TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW, SUBSCRIBER AGREES THAT THE ENTIRE LIABILITY OF BOBCAD WITH RESPECT TO THE SERVICES, THE SOFTWARE, AND ANY OTHER PRODUCTS, MATERIALS OR SERVICES SUPPLIED BY BOBCAD SHALL BE LIMITED TO ACTUAL DIRECT DAMAGES AND SHALL NOT EXCEED IN THE AGGREGATE THE ANNUAL FEES PAID BY SUBSCRIBER TO BOBCAD DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE DATE THAT GAVE RISE TO THE CLAIM. IN NO EVENT SHALL BOBCAD BE LIABLE FOR ANY INDIRECT, PUNITIVE, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR EXEMPLARY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION FOR LOST PROFITS, LOSS OF REVENUE, LOST OR DAMAGED DATA, LOSS OF GOODWILL, OR ECONOMIC LOSS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
VI. No Rights in Data
Except for the limited license granted herein, all right, title, and interest, including copyright, in the data and information are and continue to be owned by BobCAD and/or any of its third party providers.
VII. Indemnification
Subscriber hereby agrees to indemnify, defend, and hold harmless BobCAD, its shareholders, officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, demands, complaints, losses, liabilities, setoffs, damages, or expenses (including attorney’s fees and costs) of any nature whatsoever arising out of, related to, or based on Subscriber’s breach of any representation, warranty, obligation, or covenant in this Agreement.
VIII. Damages and Relief
Subscriber acknowledges that the provisions of Section II (Access and Limited License) are of a special, unique, and extraordinary character and that a breach will cause immediate and irreparable injury to BobCAD. In addition to any other rights, BobCAD will be entitled to injunctive relief against Subscriber for breach of any term of Section II, without requirement of bond or other security.
IX. Modification Clause
Terms relating to rate schedules, available services, service specifications, and support policies are subject to change at BobCAD’s discretion without prior notice. Notice of changes will be provided by modification of this page or linked pages and updating the revision date. Continued use of this service after any revision date constitutes Subscriber’s agreement to all such changes. Material changes to other provisions, including liability limitations, warranty disclaimers, indemnification obligations, dispute resolution provisions, and governing law, may only be modified by written amendment signed by an authorized representative of each party.
X. Subscription Term and Termination
B. Termination by BobCAD
BobCAD may suspend, deactivate, or terminate Subscriber’s account for material breach of this Agreement, misuse of the Services, security concerns, legal compliance requirements, or other legitimate business reasons. Where reasonably practicable, BobCAD will provide notice of such termination.
BobCAD may also terminate this Agreement if Subscriber fails to comply with the terms and conditions of this Agreement. In such event, Subscriber must return or destroy all copies of the Licensed Software, including the License Activation Code, and all of its component parts.
XI. Effects of Termination
A. Cessation of Rights and Services
All rights granted to Subscriber in this Agreement shall immediately terminate and BobCAD will immediately cease to perform the Services.
B. No Refunds
If your services change, you cancel your subscription, or we suspend, deactivate, or cancel your account, you will not receive any refund and you will remain liable for any charges accruing prior to the termination of your account, subject to the Refund Policy set forth in Section XVII below.
C. Payment Obligations
You will pay all amounts due under this Agreement up to and through the date of termination and all costs reasonably incurred in collecting the amounts due to the Merchant of Record, currently Cleverbridge (including court costs, attorney fees, and repossession charges to the extent not prohibited by law).
D. Return of Confidential Information
You shall return to BobCAD or, at BobCAD’s option, purge or destroy all copies of any Confidential Information of BobCAD in your possession or control (except as required under any applicable statute or retention requirements), and provide a duly authorized officer’s certificate confirming same within thirty (30) days.
E. Survival of Rights
Termination of this Agreement shall not affect any right of action of either party arising from anything done or not done prior to the termination taking effect.
XII. Construction of this Agreement
A. Entire Agreement
The Terms of Use included or incorporated by reference in this Agreement constitute the entire agreement between the parties with respect to the license and use of the Software. Where BobCAD-CAM uses a Merchant of Record, currently Cleverbridge, the Merchant of Record’s applicable customer purchase terms govern the commercial transaction between the Subscriber and the Merchant of Record and are not superseded by this Agreement. No terms and conditions in any Subscriber orders or other documentation employed by Subscriber will affect the terms of this Agreement. This Agreement may only be modified by a written amendment signed by an authorized representative of each party, except as provided in Section IX (Modification Clause).
Electronic acceptance of this Agreement, electronic signatures, and communications transmitted electronically shall have the same force and effect as original written documents.
B. Non-Assignability
This Agreement shall be binding upon the original parties, and their heirs and successors. However, YOU MAY NOT ASSIGN YOUR SUBSCRIPTION TO ANYONE ELSE. The BobCAD Software License is non-transferable.
C. Fair Meaning
This Agreement shall be construed as a whole. No provision shall be interpreted against any party because such party or its legal representative drafted such provision. Each provision shall be given its fair meaning. Paragraph headings have been added for convenience and shall not be used to interpret the Agreement.
D. No Waiver
The rights, remedies, and obligations under this Agreement are cumulative. A failure of a party to exercise any right in any instance does not constitute a waiver of any rights related to any other instance. Any waiver of rights by BobCAD must be made in a signed writing by an authorized agent.
E. Severability and Substitution
If any part of this Agreement is determined to be invalid or unenforceable, the remainder of the Agreement shall continue in effect, and the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original.
F. Governing Law; Venue
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas and the federal laws of the United States applicable therein, excluding choice of law provisions; provided, however, that the Uniform Computer Information Transactions Act will not apply even if adopted as part of the laws of the State of Texas. The United Nations Convention on Contracts for the International Sale of Goods (UNCCISG) does not apply to this Agreement. Venue for any action relating to this Agreement shall be the County of Bexar, State of Texas. Subscriber and BobCAD hereby waive, to the fullest extent permitted by applicable law, the right to trial by jury in any action relating directly or indirectly to this Agreement.
G. Dispute Resolution
In the event of a dispute, the parties must first attempt to informally negotiate and resolve their conflict at the operational level through meetings between each party’s representatives with decision-making authority. If unresolved, the dispute must be submitted to upper management. Either party may seek equitable relief prior to or during negotiations to preserve the status quo. All communications during negotiations are confidential and treated as compromise and settlement negotiations under the Federal Rules of Evidence.
H. No Agents
Subscriber and BobCAD are not agents of each other.
XIII. Independent Investigation
Subscriber represents that it has read this Agreement and freely and voluntarily agrees to all its terms and conditions without modification. Subscriber has independently evaluated the desirability of entering into this Agreement and has had the opportunity to review the Agreement with an attorney. Subscriber is not relying on any representation, guarantee, or statement other than as set forth in this Agreement.
XIV. Limitations Period
Any litigation arising out of or related to this Agreement must be brought within one (1) year from the date the event giving rise to the litigation occurred.
XV. Export Restrictions
You acknowledge that the Licensed Software is subject to U.S. export jurisdiction. You agree to comply with all applicable international and national laws that apply to the Licensed Software, including the U.S. Export Administration Regulations, as well as end-user, end-use, and destination restrictions issued by U.S. and other governments. You warrant that you are not a citizen or national of a Prohibited Destination and are not obtaining the Licensed Software for a citizen or national of any country subject to a U.S. embargo.
XVI. Default Remedies
In the event Subscriber defaults on this Agreement, BobCAD is entitled to its costs of collection, including costs and reasonable attorney’s fees incurred.
XVII. Refund Policy
A. General Provisions
Subscriber shall be eligible for a refund of purchased service and software according to the terms of this Refund Policy. The Refund Policy shall not supersede or replace BobCAD’s limited warranty or disclaimer of such warranty contained in this Agreement. The Refund Policy is applicable solely within the timelines set forth herein and subject to the requirements set forth herein.
B. Software Refund Eligibility
If the BobCAD software fails to perform any of the advertised features identified at BobCAD’s website, bobcad.com (“Official Website”), you shall be eligible for a refund provided the refund request is received by BobCAD within forty-five (45) days from the date of your purchase. “Date of your purchase” refers to the date of your initial subscription payment or the date of any renewal payment. Each subscription period is evaluated independently for refund eligibility based on the forty-five (45) day window from the applicable payment date.
You shall be ineligible for a refund based on changes, modifications, and updates to the functions of the BobCAD software advertised on the official website after your purchase. Such changes, modifications, and updates are not covered under the Refund Policy.
All Third Party Software sold by BobCAD is excluded from this Refund Policy. Such software is non-refundable and all sales are final. This exclusion includes, but is not limited to, SolidWorks™, Celeritive Technologies© HSP, Mach3©, Machinist Tool Box™, and any other third party products offered by BobCAD.
C. Purchases through an Authorized BobCAD Reseller
If you purchased the BobCAD software through an authorized software reseller, you MUST go through your reseller for a return. The same guidelines in this policy would apply in addition to any return policies that your reseller may have.
D. Shipping & Handling Fees
Shipping and Handling fees apply to ALL products being delivered to the customer. Once a product has been shipped, the original shipping and handling fees will not be refunded. This charge will be listed in writing on your credit invoice.
E. Refund Eligibility Requirements
To qualify for a refund:
- The technician you work with must be able to determine that the BobCAD software you purchased will NOT generate standard ISO G-Codes for your CNC machine control.
- The technician must be able to determine that the BobCAD software did not provide an advertised function on our official website at the time of your purchase.
- Refusal to work with a technician will result in automatic denial of your refund request.
- It is the responsibility of the customer to ensure their machine control accepts standard ISO G-Code. Returns will not be accepted based on post processor issues if the CNC machine control does not accept Standard ISO G-Code.
- If a customer purchases the BobCAD software BEFORE the purchase of a machine, the customer may not return the software due to machine or controller issues.
F. General Refund Limitations
BobCAD Software is non-transferable. BobCAD does not offer 100% satisfaction guarantees on any software or service sold. BobCAD offers a free demo on our website for all products sold, allowing prospective and existing customers the opportunity to test the software risk free before purchase. It is the responsibility of the consumer to ensure the BobCAD software fits their specific machining needs before the software is purchased.
G. How to Request a Refund
Submit a formal request in writing by emailing refund@bobcad.com. For software returns, you must cooperate with a technical support representative’s inquiry into your eligibility for a Software Refund. You can contact technical support by calling (727) 489-0003.
H. Returning Software
If you have received approval for a return, you will receive a Return Merchandise Authorization (RMA) number in writing with full instructions on how to properly return the BobCAD software. Write your RMA number clearly on the outside of your package. Upon receiving an RMA number, you will have thirty (30) days to send the software back to BobCAD Inc. If the software is not received within thirty (30) days, BobCAD Inc. has the right to rescind the approved refund. Packages received without an RMA number on the outside of the box will be refused. If you have registered your software, you must call BobCAD toll free at 877-262-2231 and de-authorize all seats of the BobCAD software version you are returning before returning it. If you purchased a hard lock (dongle) key, you must return all hard lock (dongle) keys.
XVIII. Support Services and Product Lifecycle
A. Support Services
The Support Services are provided in accordance with the product lifecycle policy outlined below.
B. BobCAD Product Lifecycle
Active Support: Once a Release of a BobCAD Product becomes generally available, it will enter the Active Support lifecycle period. During Active Support, BobCAD’s Technical Support Engineers will work with Subscriber to resolve incidents, handle bug issues, and address feature requests. Active Support will be provided for at least one Release within a Major Release Family for twelve (12) months from the date of the initial Major Release.
Passive Support: If a release of a BobCAD Product is beyond the period of Active Support, BobCAD may designate certain BobCAD Products eligible for a Passive Support lifecycle. During Passive Support, BobCAD’s Technical Support Engineers will work with Subscriber to resolve Incidents. Subscriber is not eligible for Service Packs, Patches, Hotfixes, or other Workarounds and must upgrade to an Active Support Release to receive such updates.
Unsupported Versions: BobCAD Technical Support will not be able to assist, modify, or create post-processors for unsupported versions. A version’s Passive Support typically extends 3 versions back. Installation of older versions on newer operating systems is not supported. At BobCAD’s discretion, registration or new license activation codes will continue for unsupported versions for a period of usually five (5) years.
Application Retirement: Retired versions of BobCAD will no longer be hosted or provided by BobCAD Inc. and new software license registrations will no longer be issued. It is your responsibility to keep a backup of the licensed hardware and software to have access to the license.
XIX. Advantage Plan Plus Support
The term of a purchased Advantage Plan Plus Base Support shall begin on the date of purchase and acceptance of these terms and continue through the third anniversary of said purchase. It shall automatically renew for additional three (3) year terms unless and until you provide ninety (90) days’ written notice to BobCAD with your intent to forego additional premium support services. Years subsequent to the first will be invoiced annually approximately one (1) month prior to the anniversary of your plan.
Non-payment is grounds, at BobCAD’s sole discretion, for suspension of Advantage Plan Support services until said payment is made. Suspension of your Plan will not excuse any payments or other obligations hereunder. Advantage Plan Plus services are itemized at https://bobcad.com/support/advantage-plans/ and are subject to modification at BobCAD’s reasonable discretion.
XX. Online Training Terms
Online Training (OLT) programs purchased from BobCAD are time-bound and non-transferable. Access begins on the original date of sale and expires as follows:
OLT 90: Valid for 90 days from the date of purchase.
Online Training – 1 Hour (Exp. 12 Mo.): Valid for 12 months from the date of purchase.
It is the responsibility of the customer to utilize all training within the specified access period. Any unused training hours will expire at the end of the designated term and cannot be carried over, transferred, or refunded.
If a customer does not engage or schedule training sessions within the access period, BobCAD reserves the right to mark all remaining training as expired. Any additional training services requested after expiration will require a new purchase at the current list price. Customers are encouraged to schedule their sessions promptly to ensure they receive the full value of their training investment.
XXI. Post Processor Policy
BobCAD’s post processor department staff require correct and accurate information to complete post creation/modification. If all required and requested information is not able to be delivered by the customer, a solution to how this information will be obtained must be established at the beginning of the post request cycle, or significant delays can be expected.
BobCAD assumes no responsibility for correct code output for customers who are unable or unwilling to deliver all necessary information requested by BobCAD Posting Department staff. BobCAD and staff are not responsible for sourcing information or troubleshooting how a customer’s CNC machine tool operates for the purpose of creating the post processor. BobCAD will attempt to assist when possible, but does not hold responsibility for sourcing necessary data.
Refunds for software or Services including post processors will not be approved if the information required to complete post processor modification/creation is not submitted and received. If there is an issue with a customer’s machine, it is the customer’s responsibility to source the information that leads to the proper format of how the NC program needs to be created. If that information is not provided, the refund will be denied.
During the post processor creation/modification process, it is often necessary for the customer to perform testing on the customer’s machine to verify correct function of the code being generated by the post processor. BobCAD Posting Department staff will attempt to make follow-up contact with the customer no less than 3 times in a 2-week period. If the customer does not respond or provide testing results within 2 weeks, the ticket will be noted as “Non Responsive” and closed. When/if the customer responds after the ticket has been closed, the ticket will be re-opened; however, the customer will have forfeited their position in the queue and will have to wait for their queue position to be reached.
XXII. U.S. Government License Rights
All Licensed Software provided to the U.S. Government pursuant to solicitations issued on or after December 1, 1995 is provided with the commercial license rights and restrictions described elsewhere herein. All Licensed Software provided to the U.S. Government pursuant to solicitations issued prior to December 1, 1995 is provided with “Restricted Rights” as provided for in FAR, 48 CFR 52.227-14 (JUNE 1987) or DFAR, 48 CFR 252.227-7013 (OCT 1988), as applicable. XXIII. Additional Software/Services
This Agreement applies to updates, supplements, add-on components, or Internet-based services components of the Licensed Software that BobCAD may provide to you or make available to you after the date you obtain your initial copy of the Licensed Software, unless they are accompanied by separate terms. BobCAD reserves the right to discontinue Internet-based services provided to you or made available to you through the use of the Licensed Software.
XXIV. Separation of Components
The Licensed Software including the License Activation Code is licensed as a single product. Licensed Software may include multiple components or software applications. The Licensed Software may not be separated for use on more than one PC within the guidelines of Section II.
